GENERAL PROVISIONS

2. The personal data controller of users is: [P1]Domotel Sp. z o.o. with its registered office in Gdańsk 80-755, ul. Szafarnia 10, entered into the Register of Entrepreneurs of the National Court Register under the number KRS 0000384263, with a share capital of PLN 5,000.00 fully paid (hereinafter "We", the Controller).

PERSONAL DATA – PURPOSES OF PROCESSING (WHY WE PROCESS YOUR DATA)
In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation - hereinafter "GDPR"), we inform that:
1. We process data for the following purposes:
a. performance of a contract or taking steps at the request of the data subject prior to entering into a contract (legal basis: Art. 6(1)(b) GDPR),
b. handling inquiries (Art. 6(1)(f) GDPR),
c. consideration of complaints and claims (Art. 6(1)(b) GDPR),
d. storing documentation and fulfilling legal obligations incumbent on the Controller (Art. 6(1)(c) GDPR),
e. sending newsletters (Art. 6(1)(a) GDPR),
f. monitoring and improving the quality of provided services – survey or questions regarding the quality of provided services (Art. 6(1)(f) GDPR),
g. displaying personalized commercial information on social networks (Art. 6(1)(a) GDPR)
h. legally justified interests of the Controller:
- carrying out direct marketing by contacting you via available communication channels (however, in case of communication via electronic means – such as email or phone number – only with your consent or service request);
- to ensure the protection and safety of persons and property, in particular by operating a video monitoring system in the hotel (hereinafter: Monitoring) recording the image of persons on the hotel premises. The operation of the Monitoring system will be communicated each time by placing a visible "Video Monitoring" sign at the entrance;
- conducting judicial/extra-judicial proceedings;
- for archiving purposes and to demonstrate compliance with statutory obligations by the Controller.
2. Providing data is voluntary but necessary to use the services. Consent, if given, is voluntary and expressed by checking a checkbox containing the consent terms.
3. If a person has consented to data processing (legal basis: Art. 6(1)(a) GDPR), data are processed until the consent is withdrawn, but after that, information about who, when and what consent was given may be archived (for the purposes of establishing, pursuing, or defending legal claims). In other cases, data are processed for a period justified by the purpose (e.g., contract performance, replying to inquiries, tax regulations, etc.)

5. Every data subject has the right to access their personal data, correct, delete or limit their processing, the right to object, the right to data portability, and the right to file a complaint with the supervisory authority.
6. Transaction data, including personal data, are transmitted directly by the user to the payment service provider.
7. Visitors to the Website can fill out a form to subscribe to the newsletter and provide an email address and/or phone number as the basis for automatic contact.
8. Visitors to the Website can consent to our running advertising campaigns on social networks targeted based on an email address.
DATA RECIPIENTS
We use services of software development and IT system maintenance companies, and other entities supporting us in delivering our services (couriers, reservation platforms, service and goods suppliers, marketing agencies), with whom we have appropriate agreements. These agreements cover data processing principles and confidentiality. Your data, if accessible by these companies, may be processed solely for the proper provision of services.
DATA RETENTION PERIOD
1. Personal data processed based on a separate consent (Art. 6(1)(a) GDPR) will be processed until its withdrawal;
2. Personal data processed in connection with the conclusion or performance of a contract will be processed during the term of the contract (hotel services) concluded with you, and also after its termination until the end of the statute of limitations period of potential claims arising from the contract according to applicable legal regulations;
3. Personal data processed in connection with fulfilling legal obligations, e.g., tax and accounting, electronic service provision, will be processed for the period indicated in laws imposing specific obligations on the Controller or until they are fulfilled.
4. Processing of your personal data based on the Controller's legitimate interest (e.g., direct marketing, profiling, analytical purposes) will be carried out until you object to data processing for these purposes, unless the Controller demonstrates the existence of legally justified grounds overriding your interests, rights and freedoms or grounds for establishing, pursuing or defending claims. Processing of personal data for marketing purposes will be performed during the term of the contract or until you object to such processing.
5. Personal data collected by monitoring are generally stored for a period of 30 days. In justified cases, where it is justified by the Controller's legal interest or results from legal provisions, personal data will be stored for the time necessary to fulfill the Controller's legal obligations or satisfy his legally justified interest.
AVAILABLE RIGHTS:
You have the right to:
- request access to your personal data from the Controller, rectification, deletion, restriction of processing, as well as the right to object to processing and the right to data portability;
- withdraw consent to the processing of personal data at any time without affecting the lawfulness of processing based on consent before its withdrawal;
- file a complaint with the supervisory authority, which is the President of the Personal Data Protection Office. Providing your personal data is voluntary, but some data are necessary to conclude and perform a contract. Failure to provide certain data may result in refusal to conclude a contract or inability to properly perform it.
RIGHT TO OBJECT
1. You have the right at any time to object – for reasons related to your particular situation – to the processing of your personal data based on the legitimate interest of the Controller or a third party, including profiling based on this provision. In such a case, we will no longer be allowed to process this personal data unless we demonstrate the existence of important legitimate grounds for processing overriding your interests, rights and freedoms, or grounds for establishing, pursuing or defending claims.
2. Moreover, if your personal data are processed for direct marketing purposes, you have the right to object at any time to such processing, including profiling to the extent that it is related to such direct marketing.
COOKIE POLICY.
We collect "Other Data", which generally do not involve revealing the user's identity nor relate directly to an identified person. To the extent that Other Data reveal a specific user's identity or concern a person, we will treat Other Data as Personal Data. Other data include:
- User's browser or device. We collect certain data through the user's browser or automatically through their device, such as Media Access Control (MAC) address, computer type (Windows or Apple), screen resolution, operating system name and version, device manufacturer and model, language, type and version of the web browser, and the name and version of Online Services (such as Apps) used. We use these data to ensure the proper functioning of Online Services.
- Use of Apps. We collect specific data when the user downloads and uses the App, including App usage data, date and time of access to our servers via the App on the user's device, and information about data and files downloaded to the App based on the user's device number. We use these data to ensure proper functioning of Online Services. Our Apps may contain software development kits (SDKs) from third parties that may collect and transmit Other Data to enable various features in the App. We may also collect mobile device advertising identifiers to improve and personalize the user experience and deliver appropriate products, content, or advertisements displayed on our website, apps, or external ads.
- Changing app preferences regarding collection of mobile device advertising identifiers.
- Optional app features. Our Apps may contain optional features provided by the device's operating system to developers. To improve user experience, we may ask for consent to use the device’s location, camera, or other features (e.g., using the user's device camera to capture credit card information). Users may deny permission, and features requiring them may then be unavailable. To manage these permissions, go to device settings.
- Cookies. We collect certain data from cookies, which are pieces of data stored directly on the user's computer or mobile device. Cookies allow us to collect information about browser type, time spent on Online Services, visited pages, referring URL, language preferences, and other aggregated traffic data. We use functional cookies to obtain data to ensure security, ease navigation, display content more effectively, collect statistics, personalize usage of Online Services, and recognize the user’s computer to assist in using Online Services. We also collect statistical cookie data on Online Services usage to continuously improve design and functionality, understand usage, and help resolve issues. Advertising cookies allow us to select ads or offers likely attractive to the user and display them during use of Online Services. We also use them to send marketing emails and track responses to online ads and marketing emails.
- Manage cookie preferences: Users can choose whether to accept cookies by managing tracking preferences through clicking "Tracking Preferences" at the bottom of our homepage or changing browser settings. Not accepting cookies may cause some inconvenience in using Online Services, e.g., inability to recognize the user’s computer requiring login at each visit. Users also won’t receive ads or offers matching their interests and needs. Currently, we do not respond to browser "Do-Not-Track" signals.
- Third-party advertising:
- We may use external advertising companies to display ads about goods and services that may interest the user when using Online Services, other websites, or online services. To serve such ads, these companies place or recognize unique cookies in the web browser (including via pixel tags). - Pixel tags and other similar technologies. We collect data from pixel tags (also known as web beacons and clear GIFs), used with some Online Services, among others to track user activities on Online Services (including e-mail recipients), measure success of marketing campaigns, and compile statistics about the use of Online Services.
- Analytics. We collect data via Google Analytics and Adobe Analytics, which use cookies and technologies to collect and analyze usage data of Services. These services also collect data concerning use of other websites, apps, and online resources. - User IP address. We obtain the user's IP address, i.e., a number automatically assigned to the computer used by the user by their Internet Service Provider (ISP). The IP address is identified and automatically recorded in our server log files when the user accesses Online Services, along with the visit time and visited pages. We use IP addresses to calculate usage levels, diagnose server issues, and administer Online Services. The user’s approximate location can also be obtained based on the IP address.
- Aggregated and segmented data. We may aggregate collected data so that aggregated data cannot personally identify any user. We may also use both personal data and other data to segment customers into groups to provide better-targeted ads.
- Precise location services. With user consent, we may determine the exact physical location of their device using satellite, cell tower, Wi-Fi signals, or other technologies. We will collect this data if the user consents via the App or another program (during first login or later) to improve special offers and enable location-based features on the user’s device. If the user consents to share location, the App or another program will continue collecting location data based on how the user chose to share it.
- Opting out of precise location: the user can specify via the device operating system to always share location, only when the app is used, or never.
